Our food donors and recipients can be assured that we take food safety very seriously.

• We only accept food from regulated food businesses, such as hotels, caterers, cafeterias, and restaurants, which have agreed to follow our guidelines.
   
• Our drivers are trained in safe food handling and will reject any food donation that doesn't meet our safety standards.

• Our trucks are refrigerated to keep food at safe temperatures.

• Our recipient agencies have met our food handling and storage requirements, are subject to periodic inspection by the City Health Department and have agreed to follow our guidelines.  

LIABILITY

In the past, many food establishments were reluctant to participate in food donation because they feared litigation. With the needs so great and billions of pounds of food getting wasted every year, the Federal Government and state governments passed legislation to protect food donors from liability. The text of the law is available here. 

1. Federal Law: The "Bill Emerson Good Samaritan Food Donation Act" of 1996 shields food donors from civil and criminal liability, except in cases of gross negligence, recklessness, or intentional misconduct. 
    
2. Texas State Law: The "Good Faith Donor Act" was passed in 1981 and also protects food donors from civil and criminal liability resulting from the condition of the donated items.
